ERA INTERNATIONALE SPEDITION GMBH welcomes you to our website http://www.era.de and thanks you for your interest in our company. We take the protection and security of your personal data entrusted to us very seriously and want you to feel safe and comfortable when visiting our website and using our services. Our focus is on your right to informational self-determination in accordance with Article 2 I GG in conjunction with Article 1 I GG.

Therefore, it is important to us that you know which personal data we collect from you when using our offers and services and how we process it afterwards.

§ 1       Purposes of data processing:

Insofar as we process personal data, this is done in accordance with the data protection laws permitted in this Privacy Notice and within the framework of the GDPR.

 

§ 2       Processing of personal data:

  1. Visits to our website:

We collect and store the IP address assigned to your computer in order to transmit the content you have requested from our website to your computer, e.g. texts, images, files made available for download, etc. Here, the processing is carried out for the purpose of fulfilling a contract or for carrying out pre-contractual measures in accordance with Art. 6 para. 1 lit. b GDPR. In addition, we process this data for detecting and tracking misuse in accordance with Art. 6 para. 1 lit. f GDPR.

In addition, the following information is collected and stored until automated deletion:

  • Date and time of access
  • Name and URL of the retrieved file
  • Website from which access is made (referrer URL)
  • The browser used and, if applicable, the operating system of your computer as well as the name of your access provider

 

In that regard, the legal basis is Art. 6 para. 1 lit. f GDPR. Our legitimate interest in data processing is to ensure the proper functionality of our website and the transactions that it handles.

 

  1. E-mail / Log in / Contact form:

If you send us enquiries by e-mail, your data needed for the processing of your request and for any follow-up questions will be stored and processed accordingly (Art. 6 para. 1 lit. a GDPR). This data will not be disclosed to third parties without your consent unless we are required to do so by law (Article 6 para. 1 lit. c GDPR).

 

  1. Other purposes:

Personal data will continue to be processed if you provide it to us in any other way, for example, in order to provide our services owed to you. The legal basis for this process is therefore our legitimate interest in accordance with Art. 6 para. 1 lit. b GDPR. In this respect, all data processed by us includes all that is required in the context of this Privacy Notice and in the context of the GDPR.

To the extent that we process your information for the purposes of receiving and processing your request as described above, you are required to provide us with such information. Without this data, we will not be able to carry out the corresponding processing as requested by you.

If you have consented to the processing of personal data in accordance with Art. 6 para. 1 lit. a GDPR, you may, of course, revoke your consent at any time without affecting the lawfulness of the processing on the basis of your consent until your revocation was withdrawn.

 

§ 3       Disclosure to third parties / processors:

As a rule, your details are processed exclusively for internal processing.

Data is passed on to processors only on the basis of Art. 28 para. 1 GDPR. Should it be necessary to submit your personal data to a processor, you will be notified accordingly prior to transmission. Of course, you can always revoke your consent if you do not want your personal information to be transmitted to the processor. The lawfulness of the processing on the basis of the consent until the revocation will not be affected.

In addition, your personal information will be forwarded to law-enforcement agencies and, if applicable, to third parties without your explicit consent, if it is necessary to investigate the unlawful use of our services or to prosecute you. However, this only happens if there are concrete indications of unlawful or abusive behaviour. Disclosure may occur even if it serves to enforce terms of use or other arrangements.

 

We are also required by law to provide information to certain public authorities upon request. These are, for example, law-enforcement authorities, authorities that prosecute administrative offences punishable by fines, and tax authorities, Art. 6 para 1 lit. c GDPR.

The disclosure of this data is based on our legitimate interest in the fight against abuse, the prosecution of criminal offences and the protection, assertion and enforcement of claims as long as your rights and interests in the protection of your personal data do not prevail, Art. 6 para. 1 lit. f GDPR.

 

§ 4       Submission of application documents:

In the course of your written application, including any online application, your application data will be collected and processed in the manner permissible by the GDPR. This includes, in particular:

Your contact information (first and last name, date and place of birth, address, telephone number, e-mail, etc.) and application documents (cover letter, CV, certificates, other training certificates and qualifications, etc.).

The collection and processing of your personal application data is exclusively earmarked for the filling of positions within our company. As a matter of principle, your data will only be forwarded to the in-house and specialist departments of our company responsible for the specific application process. This is necessary for the implementation of your eventual employment relationship in our company. A transfer of your personal application data to other firms / companies will not take place without your prior express consent. Any further use or transfer of your application data to third parties will not take place. A deletion of your personal application data takes place automatically six months after completion of the application process. This does not apply insofar as statutory provisions preclude a deletion, further storage is required for the purpose of providing evidence or you have expressly consented to a longer storage time in order to apply for future job openings, for example. If an employment contract with an applicant is concluded, the transmitted data will be stored and processed for the purpose of the employment relationship in compliance with legal requirements.

 

§ 5       Sales, marketing and / or advertising purposes:

We do not sell your data to third parties for marketing and / or promotional purposes.

 

§ 6       Data transmission to third countries:

A transmit of data to third countries is not planned. Incidentally, § 3 of this Privacy Notice also applies here.

 

§ 7       Safety / technical and organisational measures:

We use technical and organisational security measures to protect your data from accidental or intentional manipulation, loss, destruction or access by unauthorised persons. This also applies if external services are purchased. The effectiveness of our security measures is reviewed on a regular basis and measures are constantly being improved in line with technological developments. We also store your personal data in a controlled secure server environment that prevents unauthorised access and disclosure.

 

  1. Secure-Socket-Layer- (SSL) or Transport-Layer-Security (TLS) encryption:

Our website is secured by SSL or TLS procedure, i.e. our website uses an encrypted connection for security purposes and to protect the transmission of sensitive content. § 8       Standard terms for data deletion:

The legislature has issued various retention periods and obligations. After expiration of these terms, the corresponding data will be routinely and automatically deleted. If data is not affected, it will be deleted or anonymised if the purposes set out in this Privacy Notice cease to apply. Unless this Privacy Notice contains any other divergent provisions regarding the storage of data, data collected by us will only be stored for as long as necessary for the above purposes for which it was collected. For this, we have set up appropriate technical and organisational security measures.

 

§ 9       Other data uses and data deletion:

Further processing or use of your personal data generally only takes place if a legal provision allows this or if you have consented to the processing or use of the data. Our legitimate interest in retaining your data for 7 days lies in ensuring the proper functioning of our website and its operations so cyber-attacks and the like can be avoided.
